1. Who we are

The Service is operated by IMUSE INC, doing business as Power Place (“Power Place”, “we”, “us”, or “our”), with a place of business at 2125 Biscayne Blvd, Ste 204 #9745, Miami, Florida 33137, USA. You can reach us at power@powerplace.org. “You” means the person or entity using the Service.

2. Eligibility

The Service is intended for general audiences and is not directed at children. You must be at least 16 years old (or the age of digital consent in your country) to use it. If you are under the age of majority where you live, you may use the Service only with the involvement of a parent or guardian who agrees to these Terms. By using the Service you represent that you meet these requirements.

3. The Service

Power Place provides a curated collection of quotes and affirmations, delivered as a website and as the PowerPlace app, along with optional features such as narration, background music, sharing, widgets, and reminders. We may add, change, suspend, or remove features at any time, and content is presented for personal inspiration and education.

4. Licence to use the Service

Subject to these Terms, we grant you a personal, limited, revocable, non-exclusive, non-transferable licence to access and use the Service for your own non-commercial enjoyment. This licence does not transfer any ownership in the Service or its content to you.

5. Accounts and your device

The app works without an account or sign-up. To operate, it uses an anonymous device identifier generated on your device, as described in our Privacy Policy. You are responsible for the security of the device you use to access the Service.

6. Subscriptions, billing, and cancellation

Premium. Power Place offers an optional premium subscription that unlocks features such as narration, background music, the sleep timer, and widgets. Free features remain available without a subscription.
Billing through Apple. Subscriptions purchased in the app are sold and processed by Apple through your Apple account. Payment is charged to your Apple account at confirmation of purchase. Prices are shown in the app before you buy and may vary by region and over time.
Auto-renewal. Subscriptions renew automatically for the same period and price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
Free trials. Where a free trial is offered, any unused portion is forfeited if you purchase a subscription during the trial.
Managing and cancelling. You manage or cancel a subscription, and turn off auto-renew, in your Apple account settings. We cannot cancel an Apple subscription for you.
Refunds. Refunds for purchases made through Apple are handled by Apple under the App Store terms and applicable law.
Price changes. If we change subscription prices, the change applies to renewals after notice is given in line with Apple's requirements; you may cancel before renewal if you do not agree.

7. Acceptable use

You agree not to, and not to attempt to:

use the Service for any unlawful, infringing, or harmful purpose;
copy, scrape, harvest, or bulk-download content except as expressly allowed, or build a competing product from our content or data;
reverse-engineer, decompile, or attempt to extract source code, keys, or underlying data, except where this restriction is prohibited by law;
interfere with, overload, or disrupt the Service, circumvent rate limits or security measures, or access it through unauthorised means;
remove proprietary notices, or use the Service to infringe others' rights or to transmit malware.

8. Intellectual property

The Service, including its software, design, original writing, selection and arrangement of content, and the Power Place name and marks, is owned by us or our licensors and is protected by intellectual-property laws. Quotes are attributed to their authors and, where they originate from third-party sources, remain the works of those authors; we present them under applicable rights and for commentary, inspiration, and education. Except for the limited rights in these Terms, no rights are granted to you.

9. Sharing content you create

The Service lets you share individual quote cards (for example, as an image or short video) for personal, non-commercial use. You are responsible for how and where you share them and for complying with the terms of any platform you post to.

10. Third-party services

The Service relies on and links to third parties (for example Apple for billing, and our content-delivery, audio, and hosting providers). Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for third-party services or content.

11. Accuracy and no professional advice

We work hard to attribute quotes correctly (see our editorial policy), but we do not warrant that every attribution or piece of content is accurate, complete, or current. Content is provided for reflection only and is not professional, medical, psychological, legal, or financial advice; do not rely on it as such.

12. Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

13. Limitation of liability

To the fullest extent permitted by law, IMUSE INC and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of (or inability to use) the Service. To the extent liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us for the Service in the 12 months before the claim or USD 50. Nothing in these Terms excludes liability that cannot be excluded by law, and some jurisdictions do not allow certain limitations, so some of these may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless IMUSE INC from any claims, damages, and expenses (including reasonable legal fees) arising from your misuse of the Service or your breach of these Terms, to the extent permitted by law.

15. Suspension and termination

We may suspend or terminate your access to the Service if you breach these Terms or to protect the Service or other users. You may stop using the Service at any time. Provisions that by their nature should survive termination (such as intellectual property, disclaimers, and liability) will survive.

16. Changes to these Terms

We may update these Terms from time to time. We will change the “last updated” date below and, for material changes, provide additional notice. Your continued use of the Service after a change takes effect means you accept the updated Terms.

17. Governing law and disputes

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-laws rules. The courts of Miami-Dade County, Florida will have jurisdiction over any dispute, except where mandatory consumer-protection law in your country of residence gives you the right to bring proceedings locally.

18. Apple App Store

If you obtain the app through the Apple App Store, these Terms are between you and IMUSE INC only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You agree to comply with the applicable Apple Media Services / App Store Terms and represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

19. General

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
